  1. General Policy Statement

Winford Harter Consulting LLC (“Company”, “we”, “us”, “our”) provides professional creative and consulting services including branding, strategy, storytelling, and AI-assisted content production.
All services are governed by written agreements, invoices, or proposals that define project scope, deliverables, and payment structure.

Because our services involve intellectual property, strategic expertise, and creative work that begins immediately upon engagement, all fees paid are non-refundable once work has commenced, except as explicitly stated in this Policy or individual contract.

 

  1. Digital and Creative Services

2.1 Project-Based Work

All fees for project-based services — including brand strategy, naming, content strategy, copywriting, creative direction, campaign design, and AI-assisted deliverables — are non-refundable once initial research, planning, or production has begun.

2.2 Deposits and Retainers

Deposits or retainers paid to reserve time or initiate a project are non-refundable unless the Company cancels the project before any preparatory work begins. Retainers guarantee scheduling and resource allocation.

2.3 Client Cancellation

If a Client cancels a project after work has started, the Client remains responsible for all work performed up to the cancellation date, calculated at the agreed hourly rate or based on completed milestones.
All partially completed deliverables remain the intellectual property of the Company until full payment is received.

2.4 Company Cancellation

If the Company cancels a project for reasons unrelated to Client conduct (e.g., illness, force majeure, or unforeseen operational issue), any unearned prepaid amount will be refunded within 14 business days, unless otherwise agreed.

 

  1. Digital Products, Templates, and Educational Materials

3.1 Non-Refundable Nature of Digital Content

For all digital goods (templates, frameworks, AI-generated visuals, educational materials, or documents) delivered electronically, all sales are final. Due to the nature of digital delivery, access cannot be revoked once provided.

3.2 Suitability and Usage

Refunds are not issued for dissatisfaction with creative style, misunderstanding of content, or non-use of the product. The Client is responsible for reviewing all descriptions, previews, or demos prior to purchase.

3.3 Licensing and Access

Digital materials are licensed for personal or internal business use only and may not be resold, sublicensed, or distributed. Unauthorized sharing or resale constitutes a breach of this Policy and may void future service eligibility.

 

  1. Subscription or Membership Programs

If subscription-based offerings exist (e.g., private communities, creator platforms, or AI content access):

  • Subscriptions renew automatically unless canceled before the next billing cycle.
  • Cancellations take effect at the end of the current billing period.
  • Refunds are not issued for unused access, early cancellation, or lack of engagement.
  • The Company may terminate a subscription if a user violates Terms of Service, without refund for remaining time.

 

  1. Refunds for Technical Errors or Duplicate Payments

If a payment was duplicated, processed in error, or incorrectly charged due to a system or gateway malfunction, we will verify and issue a full or partial refund as appropriate within 10 business days of confirmation.
Refunds are returned to the original payment method only.

 

  1. Service Quality Disputes

6.1 Submission Requirements

Clients must submit any complaint regarding deliverables in writing to our billing or support email within 7 calendar days of receiving the work.
Complaints submitted after this period are considered waived.

6.2 Review and Resolution

Upon receiving a valid claim, the Company will review project scope, communications, and deliverables.
If discrepancies are verified, we may offer one of the following remedies:

  • Reasonable revisions consistent with original scope
  • A partial credit toward future services
  • A refund if no meaningful service was performed or if a billing error occurred

6.3 Exclusions

Refunds are not granted for subjective dissatisfaction, personal taste, or creative disagreement where the deliverable aligns with the agreed direction or reference materials.

 

  1. AI-Generated and Experimental Work

Given the nature of AI-assisted creative work:

  • AI outputs are produced under human supervision but may exhibit stylistic variation or non-reproducibility.
  • Refunds are not available for creative differences, interpretation, or variation from drafts, as AI generation involves probabilistic output.
  • The Company does not guarantee originality, factual precision, or copyright eligibility for AI-generated content.

 

  1. Chargebacks and Payment Disputes

Initiating a chargeback, dispute, or unauthorized reversal without first contacting us in writing violates this Policy.

In such cases, the Company reserves the right to:

  • Suspend all active and future work
  • Provide documentation to the payment processor proving service delivery
  • Pursue recovery of fees and associated costs through collections or legal action
  • Terminate ongoing or future business relationships

All chargebacks submitted after deliverable access or file delivery will be contested with full supporting evidence.

 

  1. Third-Party and External Costs

Certain services involve third-party vendors (e.g., hosting, advertising, AI providers, creative software, or domain registration).
These costs are non-refundable, as they are paid directly to external platforms beyond our control.
If such third-party services fail to deliver, we will assist in liaising with the provider but are not financially liable.

 

  1. Refund Method and Timeline

When a refund is approved:

  • Refunds are issued only to the original payment method
  • Processing may take 10–14 business days, depending on banking systems
  • Transaction fees charged by Stripe, PayPal, or banks are non-refundable unless legally mandated
  • Currency conversion differences and bank processing fees are the Client’s responsibility

 

  1. No Guarantee of Results

All services are delivered using professional care and expertise but depend on numerous external factors (e.g., algorithms, market behavior, platform policy changes).
We do not guarantee measurable results such as increased sales, engagement, or growth metrics.
Subjective dissatisfaction with creative results does not entitle a Client to a refund.

 

  1. Documentation and Proof of Work

We maintain records of deliverables, communications, and submissions for quality control and dispute verification.
These may include timestamps, file metadata, design drafts, and version history.
Clients agree that such documentation serves as sufficient proof of partial or full performance.

 

  1. Force Majeure and Delays

The Company is not liable for delays or non-performance caused by events beyond its control, including but not limited to technical failures, cyber incidents, illness, natural disasters, or regulatory actions.
In such cases, the project timeline may be extended or canceled at the Company’s discretion, with partial refunds only if no meaningful work has begun.

 

  1. Refund Eligibility Under Consumer Law

Nothing in this Policy limits any mandatory rights under consumer protection laws applicable in your jurisdiction.
For clients in the European Union, the UK, or other regions with digital-content laws:

  • Refunds may be required for defective or non-delivered digital products under applicable directives
  • Such claims must be submitted promptly with supporting evidence

We comply with all legally required refund obligations under the U.S. Federal Trade Commission (FTC) rules, EU Digital Content Directive (2019/770), and similar frameworks.

 

  1. Policy Enforcement and Governing Law

This Refund Policy forms part of and is governed by our Terms of Service.
All disputes shall be governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.
Any disputes will be resolved through binding arbitration as specified in the Terms of Service.

We may update this Policy periodically to reflect business or legal changes.
The Effective Date at the top of this page indicates the most recent revision.
Material updates will be published on this page and incorporated into future agreements.
